As I understand, the fine and ban is the court ruling based on the criminal charge of negligent driving. However, I believe you could sue the driver for negligence to recover the medical fees and damages, including future costs of taking care of the child. But no matter what can be recovered financially, it will not heal all the sadness and pain brought on the family.
