US man jailed 2½ years for having sex on beach

A man who had sex on a public beach in Florida in front of a child was jailed on Monday (July 6) for 2 1/2 years.

Jose Caballero, 40, was arrested in Bradenton Beach city in July last year after people at the beach complained that he was fondling and having sexual intercourse with a woman on the beach in the middle of the afternoon.

A four-year-old girl witnessed the couple's actions, a police report said. When the girl's mother asked Caballero to stop, he responded in a confrontational way.

His aggressive response was factored into the sentence requested, said assistant state attorney Anthony Dafonseca.

The act was videotaped by a witness.

Lawyers for Caballero previously said in court that the two did not have sex and that the woman was just dancing on Caballero to wake him up.

Caballero and his girlfriend, 21-year-old Elissa Alvarez, were found guilty of lewd or lascivious exhibition in front of a child, a second-degree felony. 

Both must register as sex offenders.

Alvarez was sentenced to time served and is now out of custody.

Caballero got a stiffer sentence as he previously served about eight years in prison for drug trafficking.
